Key Terms
DEPENDENCY : This is when the Court takes jurisdiction of children under the provisions of Welfare and Institutions Code Section 300. Often the cases and the children are referred to as 300s.
INITIAL HEARING/Detention hearing: This is when the Court will initially decide if the child will be out of the parents care, custody and control, while the case is pending. Parties are entitled to a hearing on this matter, when witnesses are able to testify.
ICWA: Indian Child Welfare Act.
JURISDICTION: At this hearing, the Court will determine if the child will be under the control of the Court.
DISPOSITION: At this hearing the Court will decide what the plan for the child will be. The Court will determine if reunification will take place and what services will be provided.
REUNIFICATION: This is when the family is provided with services to make them whole.
FAMILY MAINTENANCE: This is when the children remain in the home while services are being provided.
BYPASS; This is when the court determines that the parent will not be provided with services.
366.26 (OR .26):- Permanency Planning Hearing: At this hearing, the court will determine the permanent plan for the child. This could include termination of parental rights, adoption, guardianship, or foster care.
